How to Request Discovery (Pro Se):
ICR Discovery and Inspection: This link provides explanation regarding discovery and also provides a form for your use.
If you are not represented by an attorney and intend to represent yourself in court, you may submit a request for discovery from our office.  To do this, make the request in writing and either fax it to: 208-769-2326 or mail it to: 710 E Mullan Ave, CDA, ID 83814.  Our office has 14 days to respond to this request.  Be sure to include in the request, the specific criminal case number, citation number, your name and address or phone number if you would like to be called to pick up the discovery from our office.  NOTE: Our office will only provide these materials ONE TIME.  If you later decide to retain counsel, it will be YOUR RESPONSIBILITY to provide discovery to your attorney.

Our Office Policy regarding copying of electronic media for Discovery Responses:

For all private defense counsel and pro se defendants, our office requires a blank, recordable disk (either CD-R or DVD-R) to be provided for our office to copy any media in a criminal case.  While some private counsel may leave blank disks at our office for efficiency, a request for the media to be copied must be made to our office in addition the the Request for Discovery.  Otherwise, please schedule an appointment with our office to view the electronic media.  Additionally, when the media has been copied, an assistant from our office will call you to let you know that it is ready to be picked up.

Our Office Policy regarding SUBPOENA DUCES TECUM for Media for ALS Hearings:

When requesting audio and/or video be sent to the Idaho Transportation Department for ALS hearings, provide a pre-addressed postage paid envelope with the blank DVD-R or CD-R.

The amount of postage for a 6X9 or 6-1/2X9-1/2 envelope is $2.54.

The envelope should be addressed to:

If a pre-addressed postage paid envelope and/or blank media is not provided to our office, we will notify ITD that the requested materials were not provided by the defense and the media will not be sent.  Please note that the Idaho Transportation Department requires the media be sent to them directly from our office.
